Personal Injury Protection (PIP) Claims in Forida
If You’ve Been in a Car Accident in Florida
Florida’s Personal Injury Protection (PIP) laws were supposed to simplify the insurance claim process for people injured in automobile accidents and limit the need for litigation. However, since PIP insurance was first enacted in the 1970’s, it has confused many Florida drivers and given rise to numerous lawsuits.
Often an experienced Florida PIP attorney is necessary to help file a claim and advocate for fair compensation for an accident victim’s medical expenses, pain and suffering.
If you’ve been injured in a car accident, by all means, get the medical attention you need as soon as possible, keep a record of all of your medical expenses due to the accident, and call our office so we can help with your PIP claim.
Florida PIP Claims
It’s important to remember that in order to be eligible for PIP payment for medical expenses, you must receive initial treatment for your injuries within 14 days of an accident and the type of treatment sought must reflect the extent of the injuries you have sustained.
Typically, your PIP insurance will pay for ambulatory services, diagnostic procedures, medical and surgical services, hospital expenses, medication, and rehab. The catch is that Florida PIP pays only 80% of your medical costs, and if your injury is not considered an emergency, you are only entitled to $2,500. In addition, your insurance company has up to 60 days to investigate your claim to make sure it’s legitimate, but they must pay for your damages within 30 days, regardless of suspicions.
Florida PIP will also pay 60% of your lost wages up to $10,000, if you are disabled from the accident. To obtain this disability compensation, you have to submit a form completed by your employer to verify your wages for the 13 weeks preceding the accident. A note from your physician describing your disability might also be required.
